Since When is Juvenile Delinquency a Disability?

As I read through the abstract from Dean Hill Rivkin on Decriminalizing Students with Disabilities (h/t Glenn Reynolds), I couldn’t help but wonder what the definition of “disability” was, and whether the study was backwards. At a bet, the problem is more likely the continuing process of writing off bad behavior as a disease or disability.  The same kids we used to suspend as juvenile delinquents are now classified as disabled with ADD.
